Current situation
It is an offence for a person who knows he is infected with HIV to have sexual intercourse without first informing his partner of his HIV positive status and the partner has not voluntarily agreed to accept the risk of infection.
Proposed amendments
It is an offence for a person who is unaware of his HIV status, but who has reason to believe that he has been exposed to the risk of contracting HIV, to engage in sexual activity unless he takes certain steps to protect his partner from infection before or during the sexual activity.
